In addition to general immigration law, you can probably make use of a number of specific regulations. Orion Immigration Law has many years of experience in business immigration law, can provide you and any new employees with excellent advice, saves you lots of time and prevent stress and questions. We are more than just a relocation agency. Assistance with the immigration of your employees
Orion Immigration Law assists you and your employees with their immigration. We quickly and effectively determine which conditions apply and what processing time you can expect (and we do our best to keep it as short as possible). We check your documents and those of your employee and his or her family members, submit the (digital) applications to the competent authorities on your behalf, and handle any follow-up questions. At the same time, we involve you, your employee and accompanying family members in the process, schedule the necessary appointments and ensure that all steps are taken in the correct order and on time. This way, your new colleague can start their new job with you with confidence on day 1!
Applications for recognition as a sponsor
Recognition as a sponsor offers you, as an employer, significant advantages. Recognised sponsors can apply for, renew, amend and terminate residence permits for highly skilled migrants online via an accelerated procedure. Recognised sponsors can also easily take over highly skilled migrants from other recognised sponsors. Would you as an innovative startup or scale-up like to be recognised as a sponsor? Orion Immigration Law can help you with this. First, we will go through the conditions set by the IND with you and determine together with you what preparatory steps you may still need to take. We will help you collect the necessary documents and assess them before the IND reviews them. This ensures that the application, once we submit it on your behalf, will proceed smoothly and quickly, giving you the best possible chance of success.
Payrolling highly skilled migrants
Sometimes, as an employer, you may want to make temporary use of payroll services, for example because you have not (yet) obtained recognition as a sponsor, but already need highly skilled migrants. Or because an employee needs a highly skilled migrant residence permit only for a short period of time. In such situations, you engage a payroll company. This payroll company formally acts as a recognised sponsor. You act as a client of the payroll company and as the hirer of your employees. If you want advice on payroll services for highly skilled migrants, Orion Immigration Law is the right place to come to.
Assistance with the immigration of business owners
Are you a (co-)owner of an innovative start-up or scale-up, do you not have Dutch nationality, and would you like to apply for a residence permit for your company yourself? Orion Immigration Law will ensure that your application is thoroughly prepared and accurately guided. We have successfully assisted countless entrepreneurs in obtaining the so-called "start-up visa" as well as other and follow-up applications. As an experienced expert, Orion Immigration Law knows the ins and outs of all these immigration regulations. We have also surrounded ourselves with thorough professionals who are all eager to make a difference for you. This enables us to provide quick and to-the-point advice on the applicable conditions and the documents you will need to provide. We assess your business and work with you to prepare a thoroughly substantiated residence application. During the immigration process, we are of course available to answer all your questions and ensure that your application has the best possible chance of success.
Advice and guidance for facilitators
Are you a Dutch facilitator of foreign start-ups and are you looking for advice on your role in immigration law? Then Orion Immigration Law is the right place for you. As an independent firm, we are able to provide facilitators with thorough and targeted advice and have successfully advised and assisted numerous facilitators in the past. Together with you, we assess your risks and opportunities. With Orion Immigration Law, you can maintain the trust that authorities place in you as a facilitator.
Employment-based residence permits for non-recognised sponsors
Are you an innovative start-up or scale-up that is not yet recognised as a sponsor, but would like to employ staff from outside the EU? Recognition as a sponsor is not necessary in all cases. In many cases, for example, the European Blue Card is a good alternative to a residence permit for highly skilled migrants. In addition, there is a special scheme for key personnel of innovative start-ups and/or scale-ups. Are you an innovative start-up or scale-up looking for advice on hiring someone from outside the European Union? Then we warmly invite you to make an appointment for advice. In a short (online) consultation, we will explore the possibilities with you!
30% ruling
Do you recruit highly qualified people from abroad? There is a good chance that your employee will be eligible for the so-called '30% ruling'. This scheme offers you considerable financial scope to give your employee a tax-free allowance for the costs they incur as an expatriate in the Netherlands. Orion Immigration Law is familiar with the ins and outs of this scheme and can immediately determine with you whether your employee is eligible. We can, of course, also submit the applications for you.
Proactive self-monitoring
As an employer of expats, you must constantly comply with various rules, and those rules change regularly. A small mistake is easily made, but such a mistake can result in a high fine and significant reputation damage. If you make too many mistakes, your next applications will also be less likely to be approved. An ounce of prevention is therefore worth a pound of cure. Orion Immigration Law therefore offers you, as a business client, the option of an on-demand self-assessment. We record the information known to us for this purpose. We offer you a standard online questionnaire, which you can use to check whether your information is still correct, whether you are still applying the rules correctly, and whether any action is required. In the latter case, we will of course call you immediately.
Legal support in case of inspections and fines
Are you, as an employer, facing checks by the IND and/or the Dutch Labour Inspectorate? It is advisable to immediately engage a specialised solicitor. The solicitors at Orion Immigration Law have successfully represented business clients who were checked by the IND and/or the Labour Inspectorate. We will discuss with you which facts are important and what your rights and obligations are, prepare you for a hearing with the supervisory officials, and communicate with the competent authorities on your behalf. Do you disagree with a fine or other decision that is detrimental to you? Then we will assess your chances of appealing against it together with you.
Litigation in immigration law
Of course, it is always preferable to have your application approved, but you cannot always avoid having to litigate. Orion Immigration Law is particularly skilled in conducting objection and (higher) appeal proceedings. We have appeared before all Dutch immigration judges and even before the Court of Justice of the European Union. With Orion Immigration Law, you are assured of excellent legal assistance.
Fixed, competitive rates
Of course, you want to keep your legal costs under control. Orion Immigration Law works with fixed, competitive rates wherever possible. Our specialism enables us to quickly get to the heart of your case. Is there a clear, practical solution? Then we offer our assistance at a fixed rate. Is a particular approach more complicated? Then we will let you know immediately. We always work with you to find the most efficient solution for you and try to avoid protracted proceedings. But sometimes you simply have no choice and you have to go to court. Even then, we offer a fixed rate where possible, which you can often pay in instalments. This way, you always know what our assistance will cost you and you can keep control of your expenses.
