For employers in healthcare
Are you an employer in the healthcare sector looking to attract people from outside the European Union? You are not alone. The healthcare sector is facing major staff shortages, and this trend is expected to continue. Labour migration could be a solution. At present, there is no specific policy in the Netherlands for admitting healthcare professionals. As an employer, you are therefore dependent on the general admission rules, which are unfortunately very restrictive. Thorough preparation of your applications is therefore essential. Orion Immigration Law has a thorough understanding of the Foreign Nationals Employment Act and can therefore provide you with effective assistance.
Assistance with the immigration of highly skilled employees
Orion Immigration Law guides you and your employees through the immigration process. We quickly and effectively determine which conditions apply and what processing time you can expect (and we do our best to keep it as short as possible). We check your documents and those of your employee and his or her family members, submit the (digital) applications to the competent authorities on your behalf, and handle any follow-up questions. At the same time, we involve you, your employee and accompanying family members in the process, schedule the necessary appointments and ensure that all steps are taken in the correct order and on time. This way, your new colleague can start their new job with you with confidence on day 1!
Applications for recognition as a sponsor
Recognition as a sponsor offers you, as a healthcare employer, significant advantages. Recognised sponsors can apply for, renew, change and terminate residence permits for highly skilled migrants online via an accelerated procedure. Recognised sponsors can also easily take over highly skilled migrants from other recognised sponsors. Would you like to be recognised as a sponsor as an employer? Orion Immigration Law can help you with this. First of all, we will go through the conditions set by the IND with you and determine together with you what preparatory steps you may still need to take. We will help you collect the necessary documents and assess them before the IND reviews them. This ensures that the application, once we submit it for you, will proceed smoothly and quickly.
Payrolling highly skilled migrants
Sometimes, as an employer, you may want to make temporary use of payrolling, for example because you have not (yet) obtained recognition as a sponsor, but already need highly skilled migrants. Or because an employee only needs a residence permit as a highly skilled migrant for a short period of time. In such situations, you can engage a payroll company. This payroll company will formally act as a recognised sponsor. You will act as a customer of the payroll and as the hirer of your employee. Orion Immigration Law is also the right place to come to for advice on payroll services for highly skilled migrants.
30% ruling
Do you recruit highly qualified people from abroad? There is a good chance that your employee will be eligible for the so-called '30% ruling'. This scheme offers you considerable financial scope to give your employee a tax-free allowance for the costs they incur as an expatriate in the Netherlands. Orion Immigration Law is familiar with the ins and outs of this scheme and can immediately determine with you whether your employee is eligible. We can also submit the applications for you.
Immigration of practically trained employees
Practically trained workers from outside the European Union are only admitted after a so-called labour market test. The Dutch authorities assess whether you, as an employer, could fill your vacancy with candidates from the so-called priority supply (Dutch nationals, EU citizens, admitted refugees and others who already have access to the Dutch labour market). Applications are more laborious than those for highly educated workers, and the outcome is also less predictable. However, as a healthcare employer, you may find that you have no choice because your vacancies would remain unfilled without labour migration from outside the European Union. Orion Immigration Law can advise you clearly in advance about this procedure. This will enable you to build up an excellent application file. Of course, we can also handle your applications for you. This will give you the best possible chance of success.
Proactive self-monitoring
As an employer of expats, you must constantly comply with various rules, and those rules change regularly. A small mistake is easily made, but such a mistake can result in a high fine and significant reputation damage. If you make too many mistakes, your next applications will also be less likely to be approved. An ounce of prevention is therefore worth a pound of cure. Orion Immigration Law therefore offers you, as a business client, the option of an on-demand self-assessment. We record the information known to us for this purpose. We offer you a standard online questionnaire, which you can use to check whether your information is still correct, whether you are still applying the rules correctly, and whether any action is required. In the latter case, we will of course call you immediately.
Legal support in case of inspections and fines
Are you, as an employer, facing checks by the IND and/or the Dutch Labour Inspectorate? It is advisable to immediately engage a specialised solicitor. The solicitors at Orion Immigration Law have successfully represented business clients who were checked by the IND and/or the Labour Inspectorate. We will discuss with you which facts are important and what your rights and obligations are, prepare you for a hearing with the supervisory officials, and communicate with the competent authorities on your behalf. Do you disagree with a fine or other decision that is detrimental to you? Then we will assess your chances of appealing against it together with you.
Litigation in immigration law
Of course, it is always preferable to have your application approved, but you cannot always avoid having to litigate. Orion Immigration Law is particularly skilled in conducting objection and (higher) appeal proceedings. We have appeared before all Dutch immigration judges and even before the Court of Justice of the European Union. With Orion Immigration Law, you are assured of excellent legal assistance.
Fixed, competitive rates
Of course, you want to keep your legal costs under control. Orion Immigration Law works with fixed, competitive rates wherever possible. Our specialism enables us to quickly get to the heart of your case. Is there a clear, practical solution? Then we offer our assistance at a fixed rate. Is a particular approach more complicated? Then we will let you know immediately. We always work with you to find the most efficient solution for you and try to avoid protracted proceedings. But sometimes you simply have no choice and you have to go to court. Even then, we offer a fixed rate where possible, which you can often pay in instalments. This way, you always know what our assistance will cost you and you can keep control of your expenses.
